1. Acceptance of Terms
By accessing or using TestBuddy (testbuddy.ai and app.testbuddy.it), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services. These terms apply to all users, including visitors, registered users, and subscribers.
2. Description of Service
TestBuddy provides an AI-powered study platform for university admission test preparation. The platform includes practice question banks, mock simulations, personalised study plans, an AI assistant ("Buddy"), digital study guides, and analytics tools. Some features are available free of charge; others require a paid subscription.
3. User Accounts
To access premium features you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to notify us immediately of any unauthorised use.
4. Subscriptions and Payments
Paid subscriptions are billed in advance on a recurring basis according to the plan you select. All prices include applicable VAT where required by law. Payments are processed securely through Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods unless required by applicable law.
5. Intellectual Property
All content on TestBuddy — including but not limited to questions, explanations, diagrams, text, software, and visual assets — is owned by or licensed to TestBuddy SRL. You may not reproduce, distribute, modify, or create derivative works without prior written permission. Your account and subscription grant you a limited, non-exclusive, non-transferable licence to access and use the platform for personal, non-commercial study purposes only.
6. Acceptable Use
You agree not to: (a) use the platform for any unlawful purpose; (b) scrape, crawl, or otherwise extract content in bulk; (c) attempt to reverse-engineer any part of the platform; (d) share your account credentials with others; (e) upload or transmit harmful, offensive, or infringing content; (f) interfere with the platform's security or availability.
7. Disclaimer of Warranties
TestBuddy is provided "as is" and "as available". We make no warranties, express or implied, regarding accuracy, reliability, or fitness for a particular purpose. We do not guarantee that the platform will be error-free or uninterrupted. Results from using TestBuddy — including exam scores — depend on many factors beyond our control.
8. Limitation of Liability
To the maximum extent permitted by applicable law, TestBuddy SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the platform. Our total aggregate liability shall not exceed the amount paid by you, if any, in the twelve months preceding the claim.
9. Changes to Terms
We may update these Terms at any time. When we make material changes we will notify registered users by email or via an in-app notice. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bologna, Italy, except where mandatory consumer protection laws provide otherwise.
